Local Law No. 2 of 2025
Town of Highland – Eldred, New York
Section 1: Purpose
The purpose of this Local Law is to preserve the cleanliness, safety, and environmental quality of the Town of Highland, including the Hamlet of Eldred, by prohibiting the improper disposal of waste on public and private property.
Section 2: Definitions
Litter: Any garbage, refuse, waste material, debris, bottles, cans, paper, plastic, food waste, mattresses, appliances, furniture, construction materials, or any other discarded objects, regardless of size.
· Public Property: All public roads, streets, parks, sidewalks, highways, rights-of-way, and any property owned, operated, or maintained by the Town of Highland, Sullivan County, or the State of New York.
· Private Property: All property is not defined as public property, whether residential, commercial, industrial, or vacant.
· Vehicle Littering: The act of discarding litter from a moving or stationary vehicle onto public or private property.
Section 3: Prohibited Acts
A. No person shall throw, deposit, or cause to be deposited any litter on public or private property, except in designated waste receptacles.
B. No person shall throw or discard litter from any vehicle onto any public roadway, public property, or private property.
C. No person shall dump or abandon large items, including but not limited to, garbage bags, mattresses, appliances, and furniture on the side of roads, in wooded areas, on vacant lots, or on any other property not authorized for waste disposal.
Section 4: Penalties
A. Any person found to have violated this Local Law shall be subject to a fine of $500 per offense.
B. Each act of littering or illegal dumping shall constitute a separate offense.
C. In addition to the fine, the court may impose community service of up to 40 hours, specifically focused on litter removal and community cleanup activities within the Town of Highland.
Section 5: Enforcement
A. This ordinance shall be enforced by the Town of Highland Code Enforcement Officers, the Sullivan County Sheriff’s Department, New York State Police, and any authorized officers of the National Park Service operating within the Town’s boundaries.
B. Law enforcement officers may issue citations based on personal observation or credible reports, including photographic or video evidence.
Section 6: Effective Date
This Local Law shall take effect immediately upon adoption by the Town of Highland Board.
